Background
Since 1997, public clients have been obliged to award so-called freelance services (usually architectural and engineering services) in accordance with the regulations of the VgV. This means that planning services with a contract value of over € 215,000 (net) for all services (including services that are not requested) must be awarded following a Europe-wide invitation to tender in a negotiated procedure.
Commercial activities (with a focus on supply services) are awarded in accordance with the VgV, as are clearly and exhaustively describable professional services and contracts in the water, energy, transport and postal services sectors.
