III. Collection and storage of personal data and the nature and purpose of its use
When you contact us, we generally collect personal data from you. Data protection is very important to us. In the following, we will inform you about the data collected, the purposes of data collection and other related aspects, broken down according to the type and manner of data processing.
1. In connection with our mandate
We collect the following information as part of our mandate:
Title, first name, last name
a valid e-mail address
Telephone number (landline and/or mobile)
bank details if required and
Information that is necessary for the assertion and defense of our client's rights within the scope of the mandate.
This data is collected,

to be able to provide him with appropriate legal advice and representation

The data processing is carried out at the client's request and is necessary for the purposes mentioned for the appropriate processing of the mandate and for the mutual fulfillment of obligations arising from the mandate agreement in accordance with Art. 6 para. 1 sentence 1 lit. b GDPR.
There is no obligation to provide us with the above personal data. However, we would like to point out that we may not be able to process the mandate or process it appropriately if you do not provide us with this data.
The personal data collected by us for the mandate will be stored until the expiry of the statutory retention period for lawyers (6 years) and for notaries (usually between 5 and 100 years) and then deleted, unless we are obliged to do so in accordance with Article 6 para. 1 sentence 1 lit. c GDPR due to retention and documentation obligations under tax and/or commercial law (in accordance with the German Commercial Code, German Fiscal Code or German Criminal Code) or there are other legitimate interests in longer storage in accordance with Art. 6 para. 1 sentence 1 lit. f GDPR or you have consented to longer storage in accordance with Art. 6 para. 1 sentence 1 lit. a GDPR. Legitimate interests in the longer storage of personal data may be that we must retain it for evidence purposes for the duration of the applicable statute of limitations (usually between 2 and 30 years). For tax and commercial law reasons, the required data must generally be stored for 10 years.
2. When you visit our website
When you visit our website www.gbm-essen.de, the browser used on your device (laptop, tablet, smartphone or similar) automatically sends information to the server of our website. 4. Analyse-Tools
Wir verwenden das Open-Source-Software-Tool Matomo zur Analyse und statistischen Auswertung der Nutzung unserer Website www.gbm-essen.de. Hierzu werden Cookies eingesetzt (siehe oben Ziffer 3). Die durch den Cookie erzeugten Informationen über die Websitenutzung (insbesondere die aufgerufenen Webseiten, die Website, von der der Nutzer auf die aufgerufene Webseite gelangt ist (Referrer), die Unterseiten, die von den aufgerufenen Webseiten aus aufgerufen werden, die Verweildauer auf den Webseiten, die Häufigkeit des Aufrufs der Webseiten) werden ausschließlich an unsere Server übertragen und in anonymisierten (pseudonymen) Nutzungsprofilen zusammengefasst. Es wird in keinem Fall die IP-Adresse mit anderen den Nutzer betreffenden Daten in Verbindung gebracht. Die IP-Adressen werden anonymisiert, so dass eine Zuordnung nicht möglich ist (IP-Masking).
Die Informationen werden verwendet, um die Nutzung der Website auszuwerten und um eine bedarfsgerechte Gestaltung unserer Website zu ermöglichen. Eine Weitergabe der Informationen an Dritte erfolgt nicht.
Rechtsgrundlage für die Verarbeitung der personenbezogenen Daten der Nutzer ist Art. 6 Abs. 1 Satz 1 lit. f DSGVO. Die Verarbeitung der personenbezogenen Daten der Nutzer ermöglicht uns eine Analyse des Surfverhaltens unserer Nutzer. 6. Lieferanten, Dienstleister und Geschäftspartner
Wir verwenden Kontakt- und Kommunikationsdaten sowie sonstige relevante personenbezogene Daten von unseren Lieferanten, Dienstleistern und Geschäftspartnern sowie deren Mitarbeitern. Diese Daten verarbeiten wir zur Durchführung der geschäftlichen Beziehung, Kommunikation sowie Kontaktpflege. Die Verarbeitung wird auf Art. 6 Abs. 1 Satz 1 lit. b, lit. c und lit. f DSGVO gestützt. Die Verarbeitung ist für die Anbahnung, Erfüllung und Abwicklung des jeweiligen Vertrags, zur Erfüllung rechtlicher Verpflichtungen (gemäß Handelsgesetzbuch und Abgabenordnung) und zur Wahrnehmung unserer berechtigten Interessen oder derjenigen eines Dritten erforderlich.
Die Daten werden so lange gespeichert, wie dies für die vorgenannten Zwecke notwendig ist. Dabei sind insbesondere die steuer- und handelsrechtlichen Aufbewahrungspflichten von bis zu 10 Jahren sowie die Dauer der anwendbaren Verjährungsvorschriften (in der Regel zwischen 2 und 30 Jahre) zu berücksichtigen.
Ohne die Verarbeitung der Daten können sich Schwierigkeiten bei der Abwicklung von Geschäftsbeziehungen ergeben.
II. Weitergabe von Daten an Dritte
Eine Übermittlung Ihrer persönlichen Daten an Dritte zu anderen als den im Folgenden aufgeführten Zwecken findet nicht statt.
Wir geben Ihre persönlichen Daten nur an Dritte weiter, wenn:

the disclosure pursuant to Art. 6 para. 1 sentence 1 lit. f GDPR is necessary for the assertion, exercise or defense of legal claims and there is no reason to assume that you have an overriding interest worthy of protection in not disclosing your data;
in the event that there is a legal obligation for disclosure pursuant to Art. 6 para. 1 sentence 1 lit. c GDPR, and
this is legally permissible and necessary for the processing of contractual relationships with you in accordance with Art. 6 para. 1 sentence 1 lit. b GDPR.
In particular, your personal data will be passed on to third parties insofar as this is necessary for the processing of client relationships with you in accordance with Art. 6 para. 1 sentence 1 lit. b GDPR. If necessary, this also includes disclosure to opposing parties and their representatives (in particular their lawyers) as well as to courts and authorities for the purpose of correspondence and for the assertion and defense of your rights, further to sub-agents, experts, authorities and institutions, service providers for file storage and disposal, logistics and delivery service providers, information and communication service providers and web hosting service providers. The data disclosed may only be used by the third party for the purposes stated. Attorney-client privilege is of course observed.
Our service providers have been and will be carefully selected by us, commissioned in writing and are bound by our instructions. They are regularly monitored by us. The service providers will not pass on your data to third parties, but will delete it after the contract has been fulfilled and the statutory storage periods have expired, unless you have consented to storage beyond this.
III. Rights of data subjects
You have the right to
in accordance with Art. 15 GDPR, to request information about your personal data processed by us. In particular, you can request information about the processing purposes, the category of personal data, the categories of recipients to whom your data has been or will be disclosed, the planned storage period, the existence of a right to rectification, erasure, restriction of processing or objection, the existence of a right to lodge a complaint, the origin of your data if it was not collected by us, and the existence of automated decision-making including profiling and, if applicable, meaningful information about its details;
in accordance with Art. 16 GDPR, to immediately request the correction of incorrect or incomplete personal data stored by us;
in accordance with Art. 17 GDPR, to demand the deletion of your personal data stored by us, unless the processing is necessary to exercise the right to freedom of expression and information, to fulfill a legal obligation, for reasons of public interest or to assert, exercise or defend legal claims;
in accordance with Art. 18 GDPR, to demand the restriction of the processing of your personal data if the accuracy of the data is disputed by you, the processing is unlawful but you refuse to delete it and we no longer need the data, but you need it to assert, exercise or defend legal claims or you have lodged an objection to the processing in accordance with Art. 21 GDPR. This will "freeze" the data and keep it usable for evidence purposes;
in accordance with Art. 20 GDPR, to receive your personal data that you have provided to us in a structured, commonly used and machine-readable format or to request that it be transmitted to another controller
in accordance with Art. 7 para. 3 GDPR, to withdraw your consent once given to us at any time. As a result, we may no longer continue the data processing that was based on this consent in the future, and
to lodge a complaint with a supervisory authority in accordance with Art. 77 GDPR. As a rule, you can contact the supervisory authority at your usual place of residence or workplace or at the registered office of our law firm.
IV. Right to object
If your personal data are processed on the basis of legitimate interests pursuant to Art. 6 para. 1 sentence 1 lit. f GDPR, you have the right to object to the processing of your personal data pursuant to Art. 21 GDPR, provided that there are reasons for this arising from your particular situation or the objection is directed against direct advertising. In the latter case, you have a general right to object, which we will implement without you having to specify a particular situation.

V. Data security
We maintain up-to-date technical measures to ensure the protection of personal data. These are always adapted to the current state of the art.
When you visit our website, we use the common SSL (Secure Socket Layer) method in conjunction with the highest level of encryption supported by your browser. As a rule, this is 256-bit encryption. If your browser does not support 256-bit encryption, we use 128-bit v3 technology instead. You can tell whether an individual page of our website is transmitted in encrypted form by the closed display of the key or lock symbol in the lower status bar of your browser.
We also use suitable technical and organizational security measures to protect your data against accidental and intentional manipulation, partial and complete loss, destruction and unauthorized access by third parties. Our security measures are continuously improved in line with technological developments. The security measures include, for example, securing our premises with an alarm system and storing certain data in a safe. Our employees are sworn to secrecy and are adequately trained. Our servers are protected against unauthorized access from outside in accordance with the state of the art.
